Abstract

The current system for recovery of medical malpractice is in efficient and unfair. At one of the spectrum, many clderly victims of malpractice are not compensated because they do not have adequate access to the current system. At the other end of the spectrum, society is bearing the cost of huge settlements to persons who are fortunate enough to gain access to a system where they can convince a jury that malpractice has occurred.
